1. Acceptance of Terms
By accessing or using Mailchk's email validation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Mailchk provides an API and web-based tools for validating email addresses, including detection of disposable, temporary, and invalid email addresses. The Service is provided on an "as-is" and "as-available" basis.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Acceptable Use
You agree not to use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Send spam or unsolicited communications
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Reverse engineer or attempt to extract source code
- Use automated means to scrape or harvest data
- Resell or redistribute the Service without authorization
5. API Usage and Rate Limits
API access is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary suspension of access. We reserve the right to modify rate limits with reasonable notice.
6. Payment Terms
For paid plans:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change pricing with 30 days notice
- Failure to pay may result in service suspension
7. Intellectual Property
The Service, including its design, features, and content, is owned by Mailchk and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILCHK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
10. Indemnification
You agree to indemnify and hold harmless Mailchk and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice on our website or sending an email. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
